These Terms of Service ("Terms") govern your access to and use of the HIGH website, mobile applications, content, and related services (together, the "Services"), and any physical products we sell (the "Products").
If you do not agree to these Terms, do not use the Services and do not purchase Products.
1. Company information

2. Acceptance of these Terms
2.1 By using the Services, creating an account, purchasing any paid feature (including a subscription), purchasing Products, or otherwise interacting with HIGH, you enter into a legally binding agreement with us under these Terms.
2.2 Where the Services present a button, tick box, or similar mechanism to accept these Terms (for example, at account creation or checkout), you must use that mechanism to proceed.
2.3 You should save or print a copy of these Terms for your records.
3. UK consumers only
3.1 The Services and Products are offered to consumers in the United Kingdom ("UK consumers").
3.2 If you access the Services from outside the UK, you do so on your own initiative and are responsible for compliance with local laws (if any). We do not represent that the Services are appropriate or available outside the UK.
4. Eligibility
You must be at least 18 years old (or the age of legal majority where you live in the UK) to use the Services or purchase Products. By using the Services, you confirm that you meet this requirement.
5. Who HIGH is (and is not)
5.1 HIGH is a digital wellness and state-optimisation platform providing experiential content (including breathwork, functional audio, visual guidance, and reflection tools) designed to support wellbeing.
5.2 HIGH is not a medical company and does not provide medical advice, diagnosis, or treatment. Nothing in the Services is a substitute for professional medical or mental health advice.
6. Safety and personal responsibility
6.1 Use the Services at your own discretion and responsibility. Stop immediately if you feel unwell, dizzy, short of breath, anxious, or experience discomfort.
6.2 Do not use breathwork, audio/visual experiences, or similar content while driving, operating machinery, or doing anything that requires full attention.
6.3 If you have a medical condition, are pregnant, or have health concerns, consult a qualified healthcare professional before using breathwork or similar activities.
7. Accounts
7.1 Some features require an account. You agree to provide accurate, up-to-date information and keep it current.
7.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
7.3 Notify us promptly if you suspect unauthorised access or a security incident.
8. Digital Services: Free Features and Paid Features
8.1 Some parts of the Services are available free of charge ("Free Features"). Other parts may require payment ("Paid Features"). Paid Features may include subscriptions and/or one-off purchases.
8.2 Paid Features may be purchased via (a) the Apple App Store or Google Play (each, a "Platform Purchase"), or (b) directly from us (a "Direct Purchase"), if offered. Your purchase channel affects billing, cancellation, and refunds as described below.
8.3 The available Paid Features (including any subscription options), duration (if applicable), renewal terms (if applicable), and price are shown in the purchase flow at the time you purchase and form part of the contract.
8.4 Where a Paid Feature is sold as a subscription, it renews automatically for successive periods of the same length unless you cancel before renewal.
8.5 Subscriptions are billed in advance at the start of each subscription period. One-off Paid Features are billed at the time of purchase. Your bank, card issuer, or payment provider may charge additional fees outside our control.
8.6 How to cancel subscriptions: (a) Platform Purchases: you must cancel via your Platform account subscription settings. We cannot cancel on your behalf. (b) Direct Purchases: you can cancel via your account settings in the Services. Cancellation takes effect at the end of the then-current subscription period unless the law requires otherwise.
8.7 Refunds: (a) Platform Purchases: refunds are processed by the relevant Platform under its policies. We cannot issue refunds for Platform Purchases. (b) Direct Purchases: except where UK law requires otherwise, we do not provide refunds because you changed your mind or did not cancel in time.
8.8 UK cancellation right (Direct Purchases): If you are a UK consumer making a Direct Purchase online, you may have a legal right to cancel within 14 days. If you request immediate access to digital content during this period, you will be asked to consent to immediate supply and acknowledge that you lose your right to cancel once supply starts.
8.9 If a technical issue on our side materially prevents you from accessing a Paid Feature, contact support at info@high.inc. Where a refund or other remedy is required by UK law, we will comply.
8.10 We may change prices for Paid Features from time to time. We will give you advance notice before a price change takes effect, and you can cancel before the effective date if you do not agree.
9. Purchases: physical Products
9.1 For Products sold via our website/app checkout, we are the seller of record unless we explicitly state otherwise at checkout.
9.2 A contract for Products is formed when we send an order confirmation.
9.3 Product prices and delivery charges are shown at checkout and form part of the contract.
9.4 Estimated delivery times are shown at checkout. Delivery dates are not guaranteed. Risk in the Products passes to you on delivery.
9.5 If you are a UK consumer, you generally have the right to cancel the contract for most non-perishable Products within 14 days after the day you receive them. You must return the Products within 14 days after telling us you want to cancel.
9.6 The 14-day cancellation right does not apply to: (a) goods that are liable to deteriorate or expire rapidly; (b) sealed goods not suitable for return for health or hygiene reasons, if unsealed after delivery; (c) any other category where UK law provides an exception.
9.7 To cancel/return, contact us at info@high.inc with your order number. We will provide return instructions.
9.8 Nothing in these Terms limits your statutory rights if Products are faulty, unsafe, or not as described.
10. Acceptable use
You agree not to: (a) misuse, reverse-engineer, interfere with, or attempt to disrupt the Services; (b) use the Services for unlawful, harmful, or abusive purposes; (c) copy, resell, or redistribute content except as permitted by these Terms or by law.
We may suspend or terminate access for violations.
11. Intellectual property
11.1 All content, software, audio, visuals, designs, trademarks, and branding in the Services are owned by or licensed to us.
11.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for your personal, non-commercial use only.
11.3 You may not reproduce, distribute, sell, or create derivative works from the Services or content unless we expressly permit it in writing.
12. User feedback and submissions
If you submit feedback, ideas, or suggestions, you retain ownership of your content. You grant us a worldwide, royalty-free, perpetual licence to use, reproduce, and adapt that feedback to operate and improve the Services.
13. Third-party services
The Services may link to or integrate with third-party platforms. We are not responsible for their content, availability, or practices. Your use of third-party services is at your own risk.
14. Availability and disclaimers
14.1 The Services are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation.
14.2 Nothing in these Terms excludes or limits any consumer rights that cannot be excluded under UK law.
15. Limitation of liability
15.1 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be limited under UK law.
15.2 Subject to clause 15.1, we are not liable for losses that are indirect or consequential.
15.3 Subject to clause 15.1, our total liability is limited to the amount you paid us for the relevant subscription period or Product order giving rise to the claim.
16. Termination
16.1 You may stop using the Services at any time. If you have an active subscription, you must cancel it to stop future renewal charges.
16.2 We may suspend or terminate access if: (a) you breach these Terms, (b) required by law, or (c) we discontinue the Services.
16.3 Clauses intended to survive termination (including IP, liability, and dispute resolution) will survive.
17. Changes to these Terms
17.1 We may update these Terms from time to time. The "Last updated" date shows when they were last changed.
17.2 If changes are material, we will provide notice in-app and/or by email.
17.3 Continued use of the Services after the effective date of an update means you accept the updated Terms.
18. Privacy
Our Privacy Policy explains how we collect and use personal data. It forms part of your relationship with us. If you have concerns, contact legal@high.inc. You also have the right to complain to the UK Information Commissioner's Office (ICO).
19. Complaints and ADR
19.1 If you have a complaint, contact us at legal@high.inc or info@high.inc and we will try to resolve it promptly.
19.2 If we cannot resolve your complaint, we will provide information about an appropriate certified Alternative Dispute Resolution (ADR) provider.
20. Governing law and jurisdiction
20.1 These Terms are governed by the laws of England and Wales.
20.2 If you live in Scotland or Northern Ireland, you may bring proceedings in your local courts. Otherwise, the courts of England and Wales will have jurisdiction.
